Louis Vuitton Demands Counterfeit Websites be Delisted
This case goes beyond Louis Vuitton ordering these websites stop using its trademark to actually looking for hundreds of websites selling Louis Vuitton replicas to be shutdown. GigaOM argues that this request, if granted, gives too much power to corporations, and the action is similar to the Stop Online Piracy Act, legislation which was widely lobbied against by web hosts and ISVs and subsequently shut down earlier this year.
In November 2011, a Nevada judge ordered search engines like Google and Bing and websites like Twitter to delist 200 sites selling counterfeit Chanel goods. The ruling demanded the sites be delisted without due process, another instance of corporations overstepping their power online.
In 2009, Louis Vuitton sued a few web hosting providers that hosted websites selling counterfeit products. It was awarded $32.4 million in damages since the court ruled that the defendants knew that its customers were using its services to infringe Louis Vuitton trademarks. In February 2012, Go Daddy worked with the Secret Service to shutdown form building site JotForm. Prior to that, it threw its support behind SOPA, only to retract it soon after, as it started to lose customers to other hosting providers.
